Under IDEA, failure to implement is one of the clearest and easiest violations to prove. The biggest problem areas are: not providing accommodations or services consistently, ignoring or loosely following a BIP, disciplining a student for disability-related behavior, refusing collaboration with special education or outside providers, and not documenting what was actually provided.
